July 19, 2005
The meeting was held at the Madison Assembly of God church and was opened at 6:00.
Board Members Present: Jim Terry, Rosemary Terry, David Seitz, Keith Ryan, Dick Clem, and Paul Hurst
Board Member Absent: Philip Gaultney
Property Manager Present: Lois Brown
Visitors Present: Rik Holman, Ed Ditto, and Bob Richardson
Reading of the Minutes: The minutes of the previous meeting were approved via email. After approval, the minutes were posted on the home page at http:Bradfordfarms.com.
Treasurer’s Report: There was no treasurer’s report. Two reports will be due next month.
Property Manager’s Report: Lois presented the monthly financial sheet for June 2005. The current cash balance is $31,939.12. This amount does not include the deposits for this month because there was no treasurer’s report. The amount of the 6 month CD (Capital for Reserve) is $13,477.80. The total balance is $45,416.92. A list of checks, check number, and amount of the checks was attached. Total expenses amounted to $4,350.60.
A Common Expense Budget was presented with a remaining balance for each line item. The board agreed that the negative balances will be typed in red.
One hundred seventy-four property owners have paid fees this year. Twelve homeowners have not paid. The owners of the vacant lots have been billed but they have not paid.
The property manager’s report was accepted unanimously.
Lois was asked for information on the following:
What is the total amount of fees owed for 2004 and before? Approximately $3900.00. This is an approximated amount because there was no treasurer’s report this month.
What is the total amount of fees owed for 2005? This information was not available because there was no treasurer’s report this month.
There was a difference of $5,583.54 on last month’s financial sheet. She explained the difference is the withdrawal from the CD for capital improvement. Lois is going to furnish the capital items and the exact amount for each item.
What is the status of the three properties we pay taxes on that are still in Mr. Breland’s name? Lois will record the quit claim deed at the courthouse when she files liens.
What is the status of collection of the homeowner who has filed bankruptcy? She reported he owes $595. We cannot get any past due money but she files a lien every year.
She was asked about the status of the resident at 122 Champions Green Drive who has never paid dues. The Holloway Credit Company has contacted him and he has disputed the debt. According to the credit company, we must prove the debt. To do this, a copy of the bylaws will be provided to the credit company.
Why did the association receive a check from Holloway Credit Company for $30.00? She does not know the reason.
Has Philip Gaultney signed the signature card at Colonial Bank? Lois does not know.
Architecture Report: No report.
Landscaping Committee Report: Dick Clem made the report. Turf Tamers has not been paid. The owner of Turf Tamers bills the association on the first of every month and has requested that he be paid within the first ten days of the month. Ms. Lois Brown, property manager, stated that Turf Tamers bills had been paid.
Maintenance Committee Report: Twelve flags have been ordered. Fourteen are on hand. The flags are stored in Dick Clem’s basement.
The muskrats have not been removed from the pond.
Welcome Committee Report: There was no report.
Old Business:
1. Jim stated the appropriate way for residents to route requests to the board is to mail the requests to P.O. Box 151. The board will consider the requests and route them to the appropriate committee if necessary.
2. Jim gave the sequence of Member Fee Notices.
Lien letters were sent July 1, 2005.
The quarterly minutes were mailed July 1, 2005.
3. Two votes were taken by the board concerning the request for the above ground pool by the residents at 124 Champions Green Drive. The first vote was that a pool above the ground is an above ground pool and a pool in the ground is an in ground pool. The majority of the board members including Keith Ryan, David Seitz, Rosemary Terry, and Jim Terry voted yes. The board members that voted no were Paul Hurst and Dick Clem. The second vote was to allow or disallow the pool. The majority of the board members including Keith Ryan, David Seitz, Rosemary Terry, and Jim Terry voted to disallow the pool and to allow the letter previously written by the president of the board to the residents at 124 Champions Green Drive to stand. Paul Hurst and Dick Clem voted against this decision. Rik Holman, a member of the architecture committee, also agreed that the pool is an above ground pool and supported the board in their decision to disallow it.
4. Ware Tree Company cannot remove the tree stump in the median for some time because of other jobs. Paul Hurst will have Chris’ Stump Grinding do the job.
5. The board voted unanimously to table the “Yard of the Month” motion until February 2006.
6. The board voted to wait until the August board meeting to discuss the subject of tree replacement.
7. Jim asked who planted the seven trees on common property behind the house at Linda Valentine’s house. These trees can become the responsibility of the association because they are on common property. There was no report of responsibility for giving permission to plant the trees. Jim will ask the resident.
8. Dick reported that Alisa Gaultney did not resign as chairman of the landscaping committee. She resigned as treasurer and as a member of the board of directors. The board so noted and acknowledged Alisa Gaultney as the chairman of the landscaping committee.
New Business:
1. The gazebo is being painted. It should be completed this week. Rosemary asked for a check to pay Erik Adams for the work. Rosemary will inspect the work and ask for an invoice before payment is made. She was given a check for $495.00. The check was signed by Lois Brown and Dick Clem.
2. There was an additional cost of $30.00 for copper for the cone on the gazebo. Rosemary paid Daniel Hubbard, of Real Deal Exteriors for this and asked for a reimbursement check from the board. She presented an invoice for the entire cost of the roofing job including the $30.00. She was given a check signed by Lois Brown and Dick Clem.
3. Jim received a letter from Leon Gill via email concerning criminal activity in the neighborhood. Mr. Gill requested the letter and the letter from the city attorney’s office to be included in these minutes. The letters are attached to the minutes.
4. A letter of complaint from a resident was given to Jim by Dick Clem concerning residents parking in front of mailboxes. The letter was read into the minutes in its entirety. The board agreed that Jim should handle the problem. Jim will contact the offending resident and try to resolve the problem. If the problem is not resolved, Jim will call the City of Madison Code Enforcement Office at city hall for assistance. Jim will send a letter to the offending resident. This letter is attached to the minutes.
5. The board will continue discussion as to the proper procedure for residents to communicate with the Board at the August Board Meeting.
6. The Board will continue discussion as to the possible location of No Parking Signs to make driving into the subdivision safer and easier.
7. Jim suggested a monthly mailing of the minutes to all residents of Bradford Farms. Discussion followed and the board voted unanimously to continue the quarterly mailing because of the expense of a monthly mailing. Lois will include a letter in the next mailing stating if the resident does not want the minutes to please reply to the homeowners association Post Office Box 151. These replies must be received by the homeowners association within 15 days of the mailing. These letters will be presented to the board.
8. A possible systemic problem was noted with our system of checks and balances between members of our Board of Directors. The Board will discuss this subject in detail at the August Board Meeting.
The next board meeting will be August 16, 2005.

Bradford Farms Homeowner’s Association
The purpose of this letter is to solicit your support and cooperation in notifying the homeowners in Bradford Farms that we have a problem with someone egging cars. The last episode occurred on Sunday night, July 17, 2005. This is not some fun-loving innocent prank. I ask the city attorney’s office for information on this offense, and as you can see it is not an innocent prank:
Mr. Gill,
In speaking with the City
Attorney/Prosecutor and the City Court Clerk, this action will be under the
State Criminal Code rather than a city ordinance. If the damage is under
$500, it will be Criminal Mischief 3rd Degree. If the damage is more than
$500, it will be a different violation. However, if the individuals are
under 18 years of age, the City cannot prosecute them because they are
juveniles – it will have to go through the County juvenile court.

On Monday
morning I walked through the neighborhood to view the damage of other vehicle and
see how many streets were involved in this episode. In addition to my vehicle, it appears that four -five other vehicles
on Champions Green Lane were vandalized and one vehicle on the corner of
Champions Green Lane and Champions Green Drive was vandalized this time. The pattern of egg tossing indicates that
the culprits were walking, and not driving, through the neighborhood. This pattern led me to believe that the
culprits live in our neighborhood.
Homeowners
and their dependents need to be aware that eggs thrown at cars can do irreparable
damage to the car’s paintwork. A new
paint job on some of the expensive cars can cost from $1000.00 to
$3000.00. In these cases, a lawsuit is
the only alternative to recover the expense for the paint job, this is in
addition to the criminal charges that will rise out of these egg tossing
incidents. “A word to the wise should
be sufficient.”
